| DECISION & ORDER ON MOTION |
Appeal by Kwanghyoung Yi from a judgment of the Supreme Court, Nassau County, dated July 6, 2009. By decision and order on motion of this Court dated August 11, 2010, the branch of the appellant's motion which was to enlarge the time to perfect the appeal was granted, and the appellant's time to perfect the appeal was enlarged until October 12, 2010. The appellant has not perfected the appeal or moved to extend the time to do so.
Now, on the Court's own motion, it is
ORDERED that the appeal is dismissed, without costs or disbursements, for failure to perfect the appeal in accordance with the prior order of the Court.
