In the Matter of Poonam Girdhar, respondent,

v Santosh Dureja, appellant.

(Docket No. O-5149/10)

DECISION & ORDER ON MOTION

Appeal by Santosh Dureja from an order of the Family Court, Nassau County, dated September 15, 2010.

Now, on the Court's own motion, it is

ORDERED that the appeal is dismissed, without costs or disbursements, as no appeal lies as of right from a nondispositional order of the Family Court in a proceeding pursuant to Family Court Act article 8, and leave to appeal has not been granted (see Family Ct Act § 1112).

RIVERA, J.P., DICKERSON, LOTT and SGROI, JJ., concur.
