DECISION & ORDER ON MOTION

Appeal by Milton Bailey from an order of the Family Court, Nassau County, dated March 18, 2009. By scheduling order of this Court dated October 7, 2010, the appellant's time to perfect the appeal was enlarged until November 8, 2010. The appellant has not perfected the appeal or moved to extend the time to do so.

Now, on the Court's own motion, it is

ORDERED that the appeal is dismissed, without costs or disbursements, for failure to perfect the appeal in accordance with the prior order of the Court.
