DECISION & ORDER ON MOTION

Motion by the respondent for a preference in the calendaring of an appeal from an order of the Family Court, Nassau County, dated March 10, 2010, and for an award of appellate attorney's fees and costs.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for a preference in the calendaring of the appeal is denied as unnecessary as the appeal has been placed on the calendar for December 13, 2010; and it is further,

ORDERED that the branch of the motion which is for an award of appellate attorney's fees and costs is denied without prejudice to seeking this relief in the Family Court, Nassau County.
