| DECISION & ORDER ON MOTION |
Motion by the appellant to hold in abeyance an appeal from a judgment of the County Court, Westchester County, rendered October 4, 2007, pending determination by the Court of Appeals of an appeal in a matter entitled People v Harnett.
Upon the papers filed in support of the motion and the papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted and the appeal is held in abeyance pending determination by the Court of Appeals of the appeal in the matter entitled People v Harnett, and the parties shall advise this Court expeditiously when the Court of Appeals determines the appeal in the matter entitled People v Harnett.
