On the Court's own motion, it is
ORDERED that its decision and order on motion dated December 7, 2010, in the above-entitled matter, on an appeal from a judgment of the Supreme Court, Queens County, rendered November 14, 2008, is amended by (1) adding to the preamble thereto after the word "brief" in the last sentence, the words "in response to the appellant's supplemental brief," and (2) adding to the second decretal paragraph thereto after the word "brief," the words "in response to the appellant's supplemental brief."
