| DECISION & ORDER ON MOTION |
Appeal by the People from an order of the County Court, Nassau County, dated May 11, 2007, which was modified by decision and order of this Court dated January 27, 2009. By decision and order dated July 7, 2009, this Court denied the respondent's application for a writ of error coram nobis to vacate, on the ground of ineffective assistance of appellate counsel, the decision and order of this Court dated January 27, 2009. In a memorandum dated October 26, 2010, the Court of Appeals reversed the decision and order of this Court dated July 7, 2009, granted the respondent's writ of error coram nobis, vacated the decision and order of this Court dated January 27, 2009, and remitted the matter to this Court for a new determination of the People's appeal.
Now, on the Court's own motion, it is
ORDERED that on or before January 14, 2011, the People are directed to file nine copies of their brief on the appeal, and serve one copy on the attorney assigned to represent the respondent on the appeal; if they be so advised they may serve and file their original brief on the appeal, a replacement brief, or their original brief plus a supplemental brief.
