Motion by the respondents for leave to reargue an appeal from a judgment of the Supreme Court, Nassau County, dated February 5, 2009, and an order of the same court dated June 23, 2009, which were determined by decision and order of this Court dated June 1, 2010, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this Court.
