Motion by the petitioner for leave to appeal to the Court of Appeals from a decision, order and judgment of this Court dated August 10, 2010, which determined a proceeding pursuant to CPLR article 78 in the nature of mandamus, inter alia, to direct the respondents to expunge certain records.
