| DECISION & ORDER ON MOTION |
Motion by the defendant pursuant to CPL 460.30 for an extension of time to take an appeal from a judgment of the Criminal Court of the City of New York, Kings County, rendered August 10, 2009. Application by the defendant to transfer the motion to the Appellate Term of the Supreme Court, Second, Eleventh, and Thirteenth Judicial Districts.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is granted, and the motion is transferred to the Appellate Term of the Supreme Court, Second, Eleventh, and Thirteenth Judicial Districts, for determination, as the motion seeks relief in connection with a judgment of the Criminal Court of the City of New York, Kings County (see CPL 450.60[4]); and it is further,
ORDERED that all further proceedings in connection with this motion shall be conducted pursuant to the rules of the Appellate Term, Second, Eleventh, and Thirteenth Judicial Districts.
