DECISION & ORDER ON MOTION

Motion by the appellant to enlarge the time to perfect an appeal from a judgment of the Supreme Court, Kings County, entered January 21, 2010, in effect, to direct the Supreme Court, Kings County, to release the respondent's trial exhibits to him, to direct the respondent to furnish originals or copies of the trial exhibits to him, and for an award of costs and an attorney's fee.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is to enlarge the time to perfect the appeal is granted, the appellant's time to perfect the appeal is enlarged until February 14, 2011, and the record or appendix on the appeal and the appellant's brief must be served and filed on or before that date; and it is further,

ORDERED that the branch of the motion which is to direct the Supreme Court, Kings County, to release the trial exhibits to the appellant is granted to the extent that the Supreme Court, Kings County, is directed to expeditiously release the respondent's trial exhibits to the respondent, and the respondent is directed to furnish originals or copies of those exhibits to the appellant, and that branch of the motion is otherwise denied; and it is further,

ORDERED that the branch of the motion which is to direct the respondent to furnish originals or copies of the respondent's trial exhibits to the appellant is granted and on or before January 14, 2011, the respondent shall furnish originals or copies of the respondent's trial exhibits in her possession to the appellant; and it is further,

ORDERED that the branch of the motion which is for an award of costs and an attorney's fee is denied.
