DECISION & ORDER ON MOTION

Appeal by Mark Baranek from an order of the Family Court, Suffolk County, dated September 1, 2009. By decision and order on motion of this Court dated October 28, 2010, the appellant was directed to perfect the appeal on or before November 30, 2010, or move in the Family Court, Suffolk County, to settle the transcripts to correct any alleged errors and provide written proof to this Court that the motion was made. The appellant was advised that if he failed to take either action by November 30, 2010, the above-entitled appeal would be dismissed.

Now, on the Court's own motion, it is

ORDERED that the appeal is dismissed, without costs or disbursements, for failure to comply with the order dated October 28, 2010.
