ORDERED that the order on application of this Court dated December 14, 2010, on an appeal and cross appeal from a judgment of the Supreme Court, Suffolk County, entered February 5, 2010, is amended by deleting from the recitation paragraph thereto the words "no papers having been filed in opposition or in relation," and substituting therefor the words "the papers filed in opposition."
