DECISION & ORDER ON MOTION

Motion by the appellant pro se, in effect, to restore to active status an appeal from a judgment of the County Court, Orange County, rendered February 14, 2007, which was deemed abandoned pursuant to 22 NYCRR 670.8(f), and to enlarge the time to perfect the appeal.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is granted, and on or before January 28, 2011, the appellant shall (1) perfect the appeal, (2) make a motion for leave to prosecute the appeal as a poor person and for the assignment of counsel, or (3) retain counsel and advise the Court that he has retained counsel.
