On the Court's own motion, it is
ORDERED that its decision and order on motion dated December 14, 2010, in the above-entitled matter, which determined a motion by the plaintiff-appellant and nonparty-appellant and a cross motion by the respondent, on an appeal from an order of the Supreme Court, Queens County, entered April 20, 2009, a judgment of the same court entered June 2, 2009, a judgment of the same court entered January 15, 2010, and an order and judgment (one paper) of the same court entered April 28, 2010, is amended by deleting from the first paragraph the words "two orders" and substituting therefor the words "an order," by deleting from the first paragraph the words "and June 2, 2009, respectively," and by adding in the first paragraph after the words "entered June 2, 2009," the words "a judgment of the same court entered January 15, 2010,".
