Motion by appellant on an appeal from a decision after trial of the County Court, Suffolk County, dated November 9, 2010, for a stay pending the determination of the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied; and it is further,

ORDERED, on the court's own motion, that the appeal is dismissed.

No appeal lies from a decision (see Hall v Paez, 77 AD3d 620 [2010]). Appellant's remedy, if he be so advised, is to cause a judgment to be entered and to appeal therefrom.
