Motion by appellant for leave to prosecute an appeal from a judgment of the Civil Court of the City of New York, Kings County, entered November 5, 2009, as a poor person, and for the assignment of counsel.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that branch of the motion by appellant seeking the assignment of counsel is denied; and it is further,

ORDERED that the branch of the motion seeking leave to prosecute the appeal as a poor person is denied without prejudice to renewal upon papers setting forth "the nature of the action" and "sufficient facts so that the merit of the contentions can be ascertained" (CPLR 1101 [a]).
