2010-10271, 2010-11536 Mary Jane Pauling-Jones, respondent, v Head Start of Rockland, Inc., et al., appellants, et al., defendants. (Index No. 12707/08)
| DECISION & ORDER ON MOTION |
Motion by the appellants to stay all enforcement proceedings in the above-entitled action, including vacating all restraints placed on their accounts, pending hearing and determination of appeals from an order of the Supreme Court, Rockland County, dated September 8, 2010 (Appellate Division Docket No. 2010-10271), and an appeal from a judgment of the same court dated November 18, 2010 (Appellate Division Docket No. 2010-11536).
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that on the Court's own motion, the appeal from the order dated September 8, 2010 (Appellate Division Docket No. 2010-10271), is dismissed, without costs or disbursements, on the ground that the right of direct appeal therefrom terminated with the entry of the judgment dated November 18, 2010 (Appellate Division Docket No. 2010-11536); and it is further,
ORDERED that the motion is denied.
DILLON, J.P., HALL, AUSTIN and COHEN, JJ., concur.
