Motion by the respondent, inter alia, to recall and vacate a decision and order of this Court dated April 13, 2010, which determined an appeal from a judgment of the Supreme Court, Orange County, dated August 4, 2008, for leave to submit a respondent's brief on the appeal, and to recalendar the appeal, or for leave to appeal to the Court of Appeals from the decision and order dated April 13, 2010.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
