| DECISION & ORDER ON MOTION |
Motion by Robert P. Guido, Esq., the court appointed inventory attorney, to be discharged of his assignment and for authorization to destroy any remaining files encompassed by the court ordered inventory which remain unclaimed. By decision and order on motion of this Court dated January 15, 2009, the respondent was suspended from practice pursuant to 22 NYCRR 691.4(l)(1)(i) and (iii), the Grievance Committee for the Tenth Judicial District was authorized to institute and prosecute a disciplinary proceeding against him, the issues raised were referred to John F. Mulholland, Esq., as Special Referee to hear and report, and Robert P. Guido, Esq., was appointed as inventory attorney, pursuant to 22 NYCRR 691.10(k). By opinion and order of this Court dated November 10, 2009, the respondent was disbarred on default, and by decision and order on motion of this Court dated December 17, 2009, due to the inability to effect personal service upon the respondent, the Court authorized service by publication. The respondent was admitted to the Bar at a term of the Appellate Division in the Second Judicial Department on August 1, 1984.
Upon the papers submitted in support of the motion and no papers having been submitted in opposition or in relation thereto, it is
ORDERED that the motion is granted, and Robert P. Guido, Esq., is discharged as inventory attorney; and it is further,
ORDERED that the inventory attorney is authorized to destroy, by incineration or shredding, any files encompassed by the Court ordered inventory which remain unclaimed.
