Application by the appellants in Appeal No. 1 and the appellants-respondents in Appeal No. 2 pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect an appeal from an order of the Supreme Court, Kings County, dated May 19, 2010 (Appellate Division Docket No. 2010-06260), and an appeal and cross appeal from an order of the same court dated August 19, 2010 (Appellate Division Docket No. 2010-10403).
Upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is granted with respect to the appeal from the order dated May 19, 2010 (Appellate Division Docket No. 2010-06260), and the appellants' time to perfect the appeal is enlarged until February 22, 2011, and the record or appendix on the appeal and the appellants' brief must be served and filed on or before that date; and it is further,
ORDERED that the application with respect to the appeal and cross appeal from the order dated August 19, 2010 (Appellate Division Docket No. 2010-10403), is denied as premature, as the time to perfect the appeal and cross appeal from that order does not expire until April 15, 2011.
