having been filed in opposition thereto, it is
ORDERED that the motion is granted, without costs, and the appeal is removed from the
February 2011 term and set down for the May 2011 term of this Court. Respondent-appellant shall file and serve its brief on or before January
10, 2011. Appellants-respondents' responding brief shall be filed and served on or before March 11, 2011. Respondent-appellant's reply brief
on the cross appeal shall be filed and served on or before April 1, 2011.
