ORDERED that the order on application of this court dated May 5, 2010, in the above-entitled appeal which granted an application by the respondent pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief on an appeal from an order of the Supreme Court, Suffolk County, dated August 26, 2009, is amended by deleting from the decretal paragraph thereof the date "June 26, 2010,' and substituting therefor the date "June 28, 2010".
