It is Ordered that the respondent-appellant's motion for a stay is granted on condition that respondent-appellant: 1- on or before January 14, 2011, tenders outstanding arrears of $4,897.41 to petitioner-respondent, without prejudice; 2- continues to pay for accruing use and occupancy on each subsequent rental due date; and 3- perfects her appeal by the April 2010 Term - the filing deadline is February 8, 2011. In the event of respondent-appellant's failure to comply with the foregoing conditions, petitioner-respondent may move on five days notice for an order dismissing the appeal.
