On the Court's own motion, it is
ORDERED that its decision and order on motion dated October 6, 2009, in the above-entitled matter, which granted a motion by the appellant , on an appeal from an order of the Supreme Court, Kings County, dated December 1, 2008, pursuant to chapter 738 of the Laws 2004, is amended by deleting from the caption the Indictment No. "9671/85", and substituting therefor the Indictment No. "967/85."
