DECISION & ORDER ON MOTION

Appeal by Rudde Delarosa, Atlantic Palace Enterprises, Inc., and Kary's Brooklyn CafÉ, Inc., from an order of the Supreme Court, Kings County, dated May 17, 2010.

On the Court's own motion, it is

ORDERED that appeal is dismissed, without costs or disbursements, on the ground that as no appeal lies from an order entered upon the default of the appealing party (see Marino v Termini, 4 AD3d 342).
