Motion by the respondent C. O., in effect, to dismiss an appeal from an order of the Supreme Court, Queens County, entered October 28, 2009, as untimely taken, to enjoin the appellant from commencing further actions without prior leave of court, and to impose a sanction upon the appellant and for an award of costs and disbursements.
