| DECISION & ORDER ON MOTION |
Motion by the respondent to dismiss an appeal from an order of the Family Court, Kings County, dated September 14, 2009, on the ground that the appellant failed to settle and file all the transcripts. Cross motion by the appellant for leave to file a replacement brief.
Upon the papers filed in support of the motion and the cross motion, and the papers filed in opposition thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that the cross motion is granted, the appellant's brief is stricken, and on or before February 22, 2011, the appellant shall serve and file a replacement brief; and it is further,
ORDERED that no additional time to file the replacement brief shall be granted.
