DECISION & ORDER ON MOTION

By decision and order on motion of this court dated June 23, 2009, the respondent was immediately suspended from the practice of law pursuant to Judiciary Law § 90(4)(f) as a result of her conviction of a serious crime; the Grievance Committee for the Tenth Judicial District was authorized to institute and prosecute a disciplinary proceeding against the respondent; and the issues raised were referred to the Honorable James A. Gowan, as Special Referee to hear and report. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on October 26, 1983, under the name Ruth Marie Pollack.

Upon the Court's own motion, it is

ORDERED that the Honorable James A. Gowan is relieved as Special Referee; and it is further,

ORDERED that the issues raised by the petition and answer are reassigned to Honorable Arthur Cooperman, a retired Justice of the Supreme Court, Queens County,125-01 Queens Boulevard, Kew Gardens, New York 11415, as Special Referee to hear and report, together with his findings on the issues, and to submit a report within 60 days after the conclusion of the hearing or the submission of post-hearing memoranda.
