| DECISION & ORDER ON MOTION |
Motion by the respondent to enlarge the time to serve and file a brief on an appeal from an order of the Supreme Court, Queens County, dated March 24, 2010, and to confirm Randall D. Unger's appointment as assigned counsel for the respondent.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is to enlarge the time to serve and file a brief is granted, the respondent's time to serve and file a brief is enlarged until January 20, 2011, and the respondent's brief must be served and filed on or before that date; and it is further,
ORDERED that the branch of the motion which is to confirm Randall D. Unger's appointment as assigned counsel for the respondent is denied as unnecessary (see 22 NYCRR 671.3[f]).
