Respondent-appellant having moved for permission to proceed as a poor person on the appeal taken herein from an order of the Family Court, Genesee County, entered in the Office of the Clerk of said Court on November 9, 2010, and for assignment of counsel,
Now, upon reading and filing the affidavit of Jerrell J.T. Jones, sworn to November 24, 2010, the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted, and
It is further ORDERED that Charles J. Greenberg, Esq., P.O. Box 102, Buffalo, New York 14207, is hereby assigned as counsel to conduct the appeal, and
It is further ORDERED that the Clerk of the Family Court, Genesee County, provide Charles J. Greenberg, Esq., with copies of all papers and transcripts of stenographic, digitally recorded, or audiotaped minutes, if any, of the proceedings had and filed in said Clerk's Office upon which the appeal is based, and
It is further ORDERED that the respondent-appellant shall file the original stipulated or settled record and ten briefs on the appeal, together with proof of service, on or before April 11, 2011, and in the event of failure to so perfect the appeal is hereby dismissed without further order.
