Now, upon reading and filing the affirmation of Charles D. Halvorsen, Esq., dated December 22, 2010, the notice of motion with proof of service thereof, the affirmation of Barbara A. Piazza, Esq., dated January 3, 2011, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted and the appeal is dismissed without further order unless perfected on or before March 14, 2011, and

It is further ORDERED that the notice of appeal filed July 26, 2010, shall be treated as valid as to the order of Family Court entered July 7, 2010.
