DECISION AND ORDER ON MOTION

Motion for extension of time to file and serve responding brief and supplemental record on appeal and to remove appeal from the February 2011 term of this Court.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is granted, without costs, to the extent that the time to file and serve the responding brief and the supplemental record on appeal, which shall contain the transcripts of hearings held on July 1, 2009 and July 9, 2009, is extended to February 7, 2011 and the appeal is removed from the February 2011 term and is set down for the March 2011 term of this Court.
