Appeals by Terri Kornicki from an order of the Surrogate's Court, Nassau County, dated February 4, 2008 (Appellate Division Docket No. 2010-11456), and a decree of the same court, dated October 18, 2010 (Appellate Division Docket No. 2010-11458).
On the Court's own motion, it is
ORDERED that the appeal from the order dated February 4, 2008 (Appellate Division Docket No. 2010-11456) is dismissed, without costs or disbursements, on the ground that the appellant previously appealed from that order, and that appeal was dismissed (under Appellate Division Docket No. 2008-02441) on May 26, 2009, on this Court's own motion, pursuant to 22 NYCRR 670.8(h), for failure to timely perfect.
