DECISION & ORDER ON MOTION

Motion by appellant on an appeal from an order of the Civil Court of the City of New York, Kings County, entered April 20, 2010, to modify a stay contained in a decision and order of this court dated October 19, 2010.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted and a stay is granted on condition appellant deposit with the Civil Court the sum of $1,321.13 within 10 days from the date of this decision and order. The sum of $7,999.92 shall be held in the escrow account of appellant's counsel pending the determination of this appeal. Appellant shall continue to comply with the other conditions contained in the decision and order of this court order dated October 19, 2010 as modified by the so-ordered stipulation dated December 3, 2010; and it is further,
ORDERED that in the event any of the above conditions are not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay on three days' notice.
