ORDERED that the order on application of this Court dated January 13, 2011, in the above-entitled matter, which granted the application by the appellant in Action No. 2 pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to perfect appeals from a judgment of the Supreme Court, Suffolk County, dated January 29, 2010, is amended by deleting from the second paragraph thereof the words "and no papers having been filed in opposition or in relation thereto", and substituting therefor the words "and the papers filed in opposition thereto".
