| DECISION & ORDER ON MOTION |
Motion by the appellant on an appeal from an order of the Supreme Court, Nassau County, dated July 7, 2010, as amended July 22, 2010, to substitute Sgarlato & Sgarlato, PLLC, as counsel, and for leave to renew his prior motion to stay the trial in the above-entitled action pending hearing and determination of the appeal.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the branch of the motion which is to substitute Sgarlato & Sgarlato, PLLC, as counsel, is denied as unnecessary, and on or before February 8, 2011, retained counsel shall either advise the Court that it is adopting the brief filed by the appellant pro se or serve and file a replacement brief; and it is further,
ORDERED that the branch of the motion which is for leave to renew the prior motion to stay the trial is denied.
