DECISION & ORDER ON MOTION

2010-1631 K CR
The People of the State of New York, Respondent, v Connie R. Mobley, Appellant.

Motion by appellant for leave to prosecute an appeal from an order of the Criminal Court of the City of New York, Kings County, entered May 19, 2010, as a poor person.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED, on the court's own motion, that the appeal is dismissed on the ground that no appeal lies from an order denying an application for a certificate of relief from civil disabilities (see Matter of Waldbaum, Inc., 190 AD2d 810 [1993]); and it is further,

ORDERED that appellant's motion is denied as academic.
