DECISION & ORDER ON MOTION

Motion by the appellant to substitute Burke, Miele & Golden, LLP, 40 Matthews Street, Suite 209, P.O. Box 216, Goshen, New York 10924, as retained counsel on an appeal from an order of the County Court, Westchester County, dated April 6, 2010, and to enlarge the time to perfect the appeal.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is granted; and it is further,

ORDERED that the appellant's time to perfect the appeal is enlarged until February 24, 2011, and the record or appendix on the appeal and the appellant's brief must be served and filed on or before that date.
