Now, upon reading and filing the affidavit of Rodger P. Doyle, Jr., Esq. sworn to January 12, 2011, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted on the condition that respondent's brief is filed and served on or before February 3, 2011, in which case the appeal shall be removed from the calendar for the term of this Court commencing April 4, 2011, and added to the calendar for the term of this Court commencing February 28, 2011.
