Reza Pedram, appellant,

v Maryam Minaahang, respondent.

(Index No. 36219/09)

DECISION & ORDER ON MOTION

Motion by Reza Pedram, inter alia, for leave to appeal to this Court from three orders of the Supreme Court, Suffolk County, dated November 5, 2010, December 1, 2010, and December 22, 2010, respectively, and to stay all proceedings in the above-entitled action pending hearing and determination of the appeals.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal from the orders dated November 5, 2010, and December 22, 2010, is denied as unnecessary as those orders are appealable as of right (see CPLR 5701[a]); and it is further,

ORDERED that the branch of the motion which is for leave to appeal from the order dated December 1, 2010, is denied; and it is further,

ORDERED that on the Court's own motion, the appeal purportedly taken as of right from the order dated December 1, 2010 (Appellate Division Docket No. 2011-00446), is dismissed, without costs or disbursements; and it is further,

ORDERED that the motion is otherwise denied.

DILLON, J.P., COVELLO, FLORIO and HALL, JJ., concur.
