Renewed motion by the appellant to recall and vacate stated portions of a decision and order on motion of this court dated January 5, 2009, as amended October 20, 2009, which, inter alia, dismissed an appeal from an order of the Family Court, Westchester County, dated April 8, 2008, and to reinstate the appeal.
