DECISION & ORDER ON MOTION

Motion by the plaintiff, in effect, for leave to appeal to this Court from an order of the Appellate Term, Second, Eleventh, and Thirteenth Judicial Districts, dated July 29, 2010, which modified an order of the Civil Court of the City of New York, Kings County, entered August 5, 2008. Application by the plaintiff for leave to file papers in reply to the oppostion for the motion.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, and upon the papers filed in support of the application and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the application and the motion are denied.
