DECISION & ORDER ON MOTION

Motion by the respondent on an appeal from an order of the Supreme Court, Nassau County, dated October 14, 2010, for leave to renew and reargue the appellant's motion to stay enforcement of the order pending hearing and determination of the appeal, which was granted by decision and order on motion of this Court dated November 24, 2010, to enlarge the record to include certain motion papers, and to enlarge the time to serve and file a brief. Application by the respondent pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief.

Upon the papers filed in support of the motion and the application, the papers filed in opposition to the motion, and no papers having been filed in opposition or in relation to the application, it is

ORDERED that the branches of the motion which are for leave to renew and reargue, and to enlarge the record are denied; and it is further,

ORDERED that the branch of the motion which is to enlarge the time to serve and file a brief and the application for the same relief are granted, the respondent's time to serve and file a brief is enlarged until June 6, 2011, and the respondent's brief must be served and filed on or before that date.
