An appeal having been taken herein from an order of the Family Court, Erie County, entered in the Office of the Clerk of said Court on March 30, 2010, and respondent-respondent having moved for an extension of time within which to file and serve his brief,

Now, upon reading and filing the affirmation of Sean D. Hill, Esq., dated January 14, 2011, the notice of motion with proof of service thereof, the statement of Charles D. Halvorsen, Esq., dated January 18, 2011, and due deliberation having been had thereon,
