DECISION & ORDER ON MOTION

Application by the appellant on an appeal from an order of the Supreme Court, Kings County, dated July 6, 2009, in effect, to amend a decision and order on motion of this Court dated December 28, 2010, which, among other things, directed the appellant to notify this Court on or before February 9, 2011, inter alia, that it has retained a new attorney and whether the new attorney adopts the record and brief, and reply brief on file with this Court.

Upon the papers filed in support of the application and the papers filed in opposition thereto, it is

ORDERED that the application is granted to the extent that the decision and order on motion of this Court dated December 28, 2010, is amended by deleting from the fourth and fifth decretal paragraphs thereof by deleting the date "February 9, 2011," and substituting therefor the date "February 22, 2011"; and it is further,

ORDERED that on the Court's own motion, the decision and order on motion of this Court dated December 28, 2010, is amended by deleting from the sixth paragraph thereof the date "February 23, 2011," and substituting therefor the date "March 10, 2011," and by deleting from the seventh paragraph thereof the date "March 11, 2011," and substituting therefor the date "March 24, 2011."
