Court's own motion to recall and vacate a decision and order of this court dated December 21, 2010, which determined an appeal from a judgment of conviction of the Criminal Court of the City of New York, Queens County, rendered April 3, 2009.
ORDERED that the motion is granted and the decision and order of this court dated December 21, 2010 (30 Misc 3d 130[A], 2010 NY Slip Op 52313[U]) are recalled and vacated and a new decision and order substituted therefor (see Appeal No. 2009-823 Q CR, decided simultaneously herewith).
