| DECISION & ORDER ON MOTION |
Motion by JME Fire Sprinkler Corp. for leave to appeal to this Court from an order of the Supreme Court, Queens County, dated November 22, 2010, and to stay a hearing to determine the amount of legal fees and expenses that WJ Harbor Ridge, LLC, should receive, pending hearing and determination of the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition and in relation thereto, it is
ORDERED that the branch of the motion which is for leave to appeal from so much of the order as directed a hearing to determine the amount of legal fees and expenses that WJ Harbor Ridge, LLC, should receive is denied; and it is further,
ORDERED that the branch of the motion which is for leave to appeal from the remaining portions of the order is denied as unnecessary; and it is further,
ORDERED that the branch of the motion which is to stay the hearing is denied.
