Wadsworth Venture Assoc., LLC v Moquette, Felipe
It is Ordered that the motion and cross motion are consolidated for disposition. It is further Ordered that the stay is extended on condition that tenant-appellant: 1- perfects the appeal by no later than the June 2011 Term - the filing deadline is April 12, 2011; 2- pays use and occupancy arrears from December 2010, January 2011 and February 2011 to the landlord on or before March 3, 2011; and 3- continues to pay for accruing use and occupancy on or before the 12th day of each month. In the event of tenant-appellant's failure to comply with the foregoing conditions, landlord-respondent may move on five days' notice for an order vacating the stay.
