DECISION & ORDER ON MOTION

Motion by the respondent to vacate the automatic stay in effect pursuant to CPLR 5519(a), pending hearing and determination of an appeal from an order of the Supreme Court, Suffolk County, dated December 9, 2010, or for an expedited briefing schedule and a preference in the calendaring of the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to vacate the automatic stay in effect pursuant to CPLR 5519(a) is granted, and the automatic stay of enforcement of the order dated December 9, 2010, is vacated; and it is further,

ORDERED that the motion is otherwise denied.
